Dormant Account and Account Maintenance Fee
1. Dormant Account
An Account will be considered a Dormant Account where no Trading Activity has occurred for a continuous period of six (6) months from the date of the Client's last Trading Activity.
For the purpose of this provision, "Trading Activity" means an executed transaction involving the purchase or sale of a financial instrument, including market buy or sell orders and executed limit or stop orders.
Deposits, withdrawals, balance adjustments, credits or other non-trading account movements shall not constitute Trading Activity for the purpose of determining whether an Account is dormant.
This provision shall apply only to trading accounts in which the Client conducts trading activity on their own behalf. Accounts designated by MGK Global as managed, operated, or otherwise not intended for direct trading by the Client shall not be subject to the Account Maintenance Fee under this provision.
2. Account Maintenance Fee
Where an Account has been classified as a Dormant Account and has a positive balance, MGK Global will charge an Account Maintenance Fee on a monthly basis.
If an Account becomes dormant during a calendar month, the first Account Maintenance Fee shall be charged at the beginning of the following calendar month.
The Account Maintenance Fee shall initially be USD 15 per month. For every additional six (6) months that the Account continuously remains dormant, the monthly Account Maintenance Fee shall increase by USD 5.
There is no maximum limit on the monthly Account Maintenance Fee, and the fee will continue to increase by USD 5 for each additional six (6) month period of continuous dormancy.
Where the base currency of the Account is not USD, the applicable Account Maintenance Fee shall be converted into the base currency of the Account using the exchange rate obtained from the exchange rate data provider designated by MGK Global at the time the fee is actually charged.
Where the converted amount includes a fractional amount, the amount shall be rounded to the nearest whole unit of the base currency.
3. Reactivation Before a Scheduled Charge
A Dormant Account will cease to be classified as dormant when the Client resumes Trading Activity.
If Trading Activity occurs after the Account has been classified as dormant but before the next scheduled Account Maintenance Fee is charged, the Account Maintenance Fee scheduled for that billing date shall not be charged.
A deposit, withdrawal, balance adjustment, credit or other non-trading account movement alone shall not reactivate a Dormant Account.
4. Insufficient or Zero Balance
If the available balance of a Dormant Account is less than the applicable Account Maintenance Fee, MGK Global may deduct the entire remaining available balance of the Account.
The deduction of an Account Maintenance Fee shall not cause the Account balance to become negative.
No Account Maintenance Fee shall be charged where the Account has a zero or negative balance.
5. Dormant Accounts with Zero Balance
Where a Dormant Account has a zero balance and no Trading Activity occurs for a continuous period of ninety (90) days while the balance remains zero, the Account may automatically freeze.
No additional Account Maintenance Fee shall accrue or be charged while the Account balance remains zero.
6. Uncollected and Retroactive Account Maintenance Fees
Where MGK Global was entitled to charge an Account Maintenance Fee but the applicable fee was not collected at the scheduled time, MGK Global reserves the right to collect such outstanding Account Maintenance Fee retroactively.
Where more than one monthly Account Maintenance Fee remains outstanding, MGK Global may collect the aggregate outstanding amount from the available balance of the Account.
Each outstanding monthly Account Maintenance Fee shall be calculated based on the fee applicable to the relevant dormant period.
Where the base currency of the Account is not USD, any amount collected retroactively shall be converted into the base currency of the Account using the exchange rate obtained from the exchange rate data provider designated by MGK Global at the time the outstanding amount is actually charged.
Where the converted amount includes a fractional amount, the amount shall be rounded to the nearest whole unit of the base currency.
A retroactive deduction shall not cause the Account balance to become negative. Where the available balance is less than the total outstanding Account Maintenance Fees, MGK Global may deduct only the remaining available balance.
7. Purpose of the Account Maintenance Fee
The Account Maintenance Fee is charged in consideration of the costs associated with the maintenance, administration, operation and compliance management of Dormant Accounts.
8. General
MGK Global reserves the right to amend the amount, frequency, calculation method or conditions of the Account Maintenance Fee in accordance with this Agreement and applicable laws and regulations.
Any material amendment to the Account Maintenance Fee shall be notified to the Client in accordance with the notification provisions of this Agreement before the amended fee becomes effective.
